The Legal Framework in NSW
Electrical workplace safety in New South Wales is governed by:
- Work Health and Safety Act 2011 (NSW) — the primary WHS legislation, placing a duty of care on all employers (PCBUs) to ensure a safe workplace
- Work Health and Safety Regulation 2017 (NSW) — including Regulation 150, which makes RCD testing mandatory in hostile environments

What NSW Businesses Must Do
Test and Tag All portable electrical equipment used in NSW workplaces must be regularly inspected and tested in accordance with AS/NZS 3760:2022. In hostile environments (construction, manufacturing, kitchens, outdoor work), test and tag is mandatory. In offices and low-risk environments, a risk assessment is required and annual testing is standard.
RCD Testing Fixed and portable RCDs must be inspected, tested and tagged in accordance with AS/NZS 3760:2022 and the WHS Regulation 2017. In hostile environments, RCD testing is mandatory.
Exit and Emergency Light Testing Exit and emergency lighting systems must be tested every 6 months in accordance with AS 2293.2. Building owners and business occupiers share responsibility for compliance.
Fire Protection Equipment Portable fire extinguishers, fire blankets and hose reels must be inspected and serviced in accordance with AS 1851:2012 and NSW fire safety legislation.
